In 2010, the Venter lab announced that it had created the first bacterium with an entirely synthetic genome. This was reported to be the first instance of ‘artificial life,’ and in the ethical and policy discussions that followed it was widely assumed that the creation of artificial life is in itself morally significant. We cast doubt on this assumption. First we offer an account of the creation of artificial life that distinguishes this from the derivation of organisms from existing life (...) and clarify what we mean in asking whether the creation of artificial life has moral significance. We then articulate and evaluate three attempts to establish that the creation of artificial life is morally significant. These appeal to the claim that the creation of artificial life involves playing God, as expressed in three distinct formulations; the claim that the creation of artificial life will encourage reductionist attitudes toward the living world that undermine the special moral value accorded to life; and the worry that artificial organisms will have an uncertain functional status and consequently an uncertain moral status. We argue that all three attempts to ground the moral significance of the creation of artificial life fail, because none of them establishes that the creation of artificial life is morally problematic in a way that the derivation of organisms from existing life forms is not. We conclude that the decisive moral consideration is not how life is created but what non-genealogical properties it possesses. (shrink)

This is a book that contrary to common practice, shows the commonalities of ancient and modern theories of freedom, law, and rational actions. Studying the works of the ancients is necessary to understanding those that follow. Thomas Chaimowicz challenges current trends in research on antiquity in his examination of Montesquieu's and Burk's path of inquiry. He focuses on ideas of balance and freedom. Montesquieu and Burke believe that freedom and balance are closely connected, for without balance within a state (...) there can be no freedom. When Montesquieu speaks of republics, he means those of antiquity as they were understood in the eighteenth century. In this view, freedom can develop only within the framework of established tradition. Edmund Burke's greatest service to political thought may lie in making use of this idea when he fought against the abstractions of the French Revolutionaries. Antiquity as the Source of Modernity examines Montesquieu's "Roman mind," meaning not an attitude influenced by the ancients, but one primarily influenced by Roman heritage. It speaks to the antithesis of monarchy and despotism in Montesquieu's thought and the influence of Tacitus and Pliny the Younger on him. The separation of powers and its relation to the concept of the mixed constitution as well as Montesquieu's smaller masterpiece Considerations on the Causes of the Grandeur and Decadence of the Romans are examined in detail. Finally, the discussion leads seamlessly to Burke, who, as a critical admirer of Montesquieu, partly incorporated his interpretation of the English constitution into his own thinking threatened by teachings of the French Revolution and its British adherents. The central idea of Antiquity as the Source of Modernity is timeless. It is that the ancient past can lead to a clearer understanding of what follows. This perspective represents a reversal of the conventional procedures for conducting this kind of research, but it is a reversal that Chaimowicz embraces in order to add a new dimension to the study and impetration of both Montesquieu and Burke. Thomas Chaimowicz was a distinguished visiting professor at the International Academy of Philosophy in the Principality of Liechtenstein and honorary professor of Roman Lay at the University of Salzburg. This lavishly illustrated book highlights the conservation importance of congregatory animals species--those which gather in vast groups. It also focuses on the irreplaceability of the congregation sites which are able to support such large gatherings of animals, fish, or birds.

Because many of Aquinas’s most distinctive philosophical claims are embedded in theological works, in order to see what his philosophy comes to it is necessary to do a great deal of extracting and reconstructing. A major school of interpretation, however, cautions that such efforts are misguided, since Aquinas’ philosophy and theology are inextricably bound together. We respond that some versions of this inseparability thesis are too strong to be true and the remainder too weak to stand in the way of (...) renewed efforts to identify Aquinas’ pure philosophical systems. Nonetheless, a good deal is to be learned about Aquinas (and about other religious philosophers) by pondering the inseparablist challenge to rational reconstruction. (shrink)

Vulnerability acts as a touchstone in this issue as we find our contributors reflecting on its intersection with gender and sexuality in different ways. Saeidzadeh draws out the significance of misrecognition in her consideration of responses to transsexuality in Iran, while Doonan highlights the potential pitfalls of relying on situational vulnerability in her critique of anti-trafficking legal discourse in the US. Lindsey considers the legal potential of situational vulnerability as a tool to address the ‘persistent failure to take action against (...) abuse’ in the UK. Durojaye and Oluduro contribute to the recent revitalisation in asking ‘the woman question’ by drawing on African law and literature to flesh out the development of a gender-sensitive, substantive equality approach from the jurisprudence of the African Commission on Human and Peoples’ Rights as it addresses vulnerability to violence. The reviewers continue this international conversation as they address recent contributions on sexuality, family formation and social security. (shrink)

Similar to parasites, malignant cells exploit the host for energy, resources and protection, thereby impairing host health and fitness. Although cancer is widespread in the animal kingdom, its impact on life history traits and strategies have rarely been documented. Devil facial tumour disease, a transmissible cancer, afflicting Tasmanian devils, provides an ideal model system to monitor the impact of cancer on host life-history, and to elucidate the evolutionary arms-race between malignant cells and their hosts. Here we provide an overview of (...) parasite-induced host life history adaptations, then both phenotypic plasticity of LH responses and changes in allele frequencies that affect LH traits of Tasmanian devils in response to DFTD are discussed. We conclude that akin to parasites, cancer can directly and indirectly affect devil LH traits and trigger host evolutionary responses. Consequently, it is important to consider oncogenic processes as a selective force in wildlife. Exposure to transmissible cancer cells, i.e., Tasmanian devil facial tumour cells, can cause changes to life history traits either as the result of phenotypic plasticity in response to exposure during the lifetime of the individual or as the result of evolutionary change in LH traits due to selection over generations.Photo credits: Frédéric Thomas, Sarah Peck, Geordie Jennings. The contributors to this issue focus on legal internationalism, including hybrid mixes with nationalist forms. They have provoked us as editors to think more about these sites and forms of engagement. Sankey shows how civic participation in the ECCC has played a key role in surfacing the gendered harms of separation and starvation. Turan highlights the problems with ICC exclusion of the experience of men and boys from sexual violence. Peroni expresses her hesitations over the Istanbul Convention given an association (...) between assumed vulnerability and migrant women, while admiring its uncoupling of violence and culture. Cruz’s interview with Wendy Brown contextualizes and expands on these themes as they consider, with other participants, the future of feminist theory in the context of neo-liberal capturing of rights and legal space. Thinking more about internationalism and commitment in this context also helps us hold a mirror up to ourselves as we reflect more critically on our own naming of FLS as an ‘international’ journal. Together these contributions, and the reviews of new work, play a role in fleshing out an editorial commitment to enacting the journal as a living thing that ‘hangs together somehow’ even as it is known differently in different places. Since the last issue of Feminist Legal Studies, we editorial board members have had lots of conversations about comfort, displacement and alienation. As we developed the programme for #FLaK2016 we thought about it as a kind of pulling ourselves out of our comfort zone, if academic events and journals ever have a comfort zone. Drawing on a mix of feminist live performance methods and a science and technology studies-type curiosity for objects of experimentation, we tried out a kitchen table method (...) of hosting a live research conversation with activists, artists and academics over two days. But we had not fully anticipated the way that the Brexit result would contribute to and complicate discomfort. A fuller analysis of FLaK awaits a later moment, but here we pick out this one aspect of our gathering—feelings of discomfort – as they animate the contributions to this issue in interesting ways. Recasting Hume and Early Modern Philosophy is a collection of essays that are all concerned with major figures and topics in the early modern philosophy. Most of the essays are concerned, more specifically, with the philosophy of David Hume (1711-1776). The sixteen essays included in this collection are divided into five parts. These parts are arranged under the headings of: (1) Metaphysics and Epistemology; (2) Free Will and Moral Luck; (3) Ethics, Virtue and Optimism; (4) Skepticism, Religion and Atheism; and (...) (5) Irreligion and the Unity of Hume’s Thought. A particularly important theme running through many of these essays is the subject of Hume’s irreligious aims and intentions. The fifth and final part of the collection is devoted to an articulation and defence of this specific understanding of Hume’s philosophical thought. (shrink)

Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the different (...) ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

Principles of procreative beneficence (PPBs) hold that parents have good reasons to select the child with the best life prospects. Sparrow (2010) claims that PPBs imply that we should select only female children, unlesswe attach normative significance to “normal” human capacities. We argue that this claim fails on both empirical and logical grounds. Empirically, Sparrow’s argument for greater female wellbeing rests on a selective reading of the evidence and the incorrect assumption that an advantage for females would persist even when (...) a serious gender imbalance is obtained. Logically, PPBs cite only pro tanto reasons and allow that the good of an individual child could be outweighed by other morally relevant considerations, such as those which take collectively suboptimal outcomes into account. There is thus no need to attach value to the “normal.”. (shrink)

Russell wird als ein Autor charakterisiert, der alle paar Jahre eine neue alternative Philosophie vorgeschlagen habe. In der vorliegenden Arbeit soll dagegen argumentiert werden, daß diese These auf einer zu oberflächlichen Ein–schätzung von Russells Denken beruht. Seine Philosophie verfügte sehr wohl über eine Einheit, die durch ihre charakteristische einheitsstiftende Methode vermittelt wurde. Dies war die Methode der logischen Analyse, die sich als Invariante (...) in allen Phasen seines Denkens durchhielt. Die logische Analyse erlaubte es, die in gegebenen Sach–verhalten enthaltenen Möglichkeiten zu explizieren. Philosophie wurde damit für Russell zu einer “Möglichkeitswissenschaft”. (shrink)

This article examines the free will problem as it arises within Thomas Hobbes' naturalistic science of morals in early modern Europe. It explains that during this period, the problem of moral and legal responsibility became acute as mechanical philosophy was extended to human psychology and as a result human choices were explained in terms of desires and preferences rather than being represented as acts of an autonomous faculty. It describes how Hobbes changed the face of moral philosophy, through his (...) Leviathan, in ways that still structure and resonate within the contemporary debate. (shrink)

The first aim of this paper is to elucidate Russell’s construction of spatial points, which is to be <br>considered as a paradigmatic case of the "logical constructions" that played a central role in his epistemology and theory of science. Comparing it with parallel endeavours carried out by Carnap and Stone it is argued that Russell’s construction is best understood as a structural representation. It is shown that Russell’s and Carnap’s representational constructions may be considered as incomplete and (...) sketchy harbingers of Stone’s representation theorems. The representational program inaugurated by Stone’s theorems was one of the success stories of 20th century’s mathematics. This suggests that representational constructions à la Stone could also be important for epistemology and philosophy of science. More specifically it is argued that the issues proposed by Russellian definite descriptions, logical constructions, and structural representations still have a place on the agenda of contemporary epistemology and philosophy of science. Finally, the representational interpretation of Russell’s logical constructivism is used to shed some new light on the recently vigorously discussed topic of his structural realism. (shrink)

Quine often argued for a simple, untyped system of logic rather than the typed systems that were championed by Russell and Carnap, among others. He claimed that nothing important would be lost by eliminating sorts, and the result would be additional simplicity and elegance. In support of this claim, Quine conjectured that every many-sorted theory is equivalent to a single-sorted theory. We make this conjecture precise, and prove that it is true, at least according to one reasonable notion of (...) theoretical equivalence. Our clarification of Quine’s conjecture, however, exposes the shortcomings of his argument against many-sorted logic. (shrink)

How can the Father, the Son, and the Holy Spirit be distinct and yet identical? Prompted by the doctrine of the divine Trinity, this question sparked centuries of lively debate. Friedman provides the first survey of the scholastic discussion of the Trinity in the 100-year period stretching from Thomas Aquinas' earliest works to William Ockham's death. Tracing two central issues - the attempt to explain how the (...) three persons are distinct from each other but identical as God, and the application to the Trinity of a 'psychological model', on which the Son is a mental word or concept, and the Holy Spirit is love - this volume offers a broad overview of Trinitarian thought in the thirteenth and fourteenth centuries, along with focused studies of the Trinitarian ideas of many of the period's most important theologians. Russell famously propounded scepticism about memory in The Analysis of Mind (1921). As he there acknowledged, one way to counter this sceptical position is to hold that memory involves direct acquaintance with past, and this is in fact a thesis Russell had advanced in The Problems of Philosophy (1911). Indeed he had there used the case of memory to develop a sophisticated falibilist, non-sceptical, epistemology. By 1921, however, Russell had rejected the early conception of memory as incompatible (...) with the neutral monism he now affirmed. In its place he argued that memory involves a distinctive type of belief whose content is given by imagery. Russell's language here is off-putting but without much distortion his later position can be interpreted as an early formulation of a functionalist theory of mind based on a causal theory of mental representation. Thus interpreted it provides the basis for a different response to Russell's sceptical thesis. (shrink)

El artículo analiza la cristología de Thomas Hobbes con el propósito de entender una de las principales causas de su descrito como un pensador cristiano o, incluso, ateo, lo que afecta eventualmente la validez de su teología política. El autor sostiene que si bien Hobbes hace uso de la Biblia como fundamento de su filosofía política, su recepción del cristianismo en general no es enteramente correcta, debido a que está fuertemente influenciada por su decisión política en favor del absolutismo. (...) Esta posición política lo lleva a escoger textos ad-hoc que apoyan su teoría y a rechazar otros que no lo hacen, dejando así fuera importantes aspectos del cristianismo, uno de los cuales, el más central, es la naturaleza de Jesucristo como Dios-hombre y la interpretación contractualista del federalismo judío. El artículo hace uso de estudios de reconocidos investigadores (Elazar, Pangle, Kraynak, Ratzinger entre otros) y el autor concluye que Hobbes exhibe una visión reduccionista del cristianismo que influye en su teología política. This is the introductory essay to the collection of essays: 'Acquaintance: New Essays' (eds. Knowles & Raleigh, forthcoming, OUP). In this essay I provide some historical background to the concept of acquaintance. I examine various Russellian theses about acquaintance that contemporary acquaintance theorists may wish to reject. I consider a number of questions that acquaintance theorists face. I provide a survey of current debates in philosophy where acquaintance has recently been invoked. The papers presented in this volume in honour of Alfonso Maieru cover some of the major topics of his research area. The institutional and intellectual life of university training in the Middle Ages, including the peculiar tradition of related works, is the focus of the papers by Louis Jacques Bataillon, William J. Courtenay, Jacqueline Hamesse, Zenon Kaluza, Loris Sturlese and Olga Weijers. Three papers, by Jacopo Costa, Pasquale Porro and Thomas Ricklin, deal with philosophical problems in Dante'sMonarchia and (...) Convivio. The complex interrelations between logic and the other main aspects of medieval philosophy, with a particular attention to theology, metaphysics and natural philosophy, are the core of the other papers by Stefano Caroti, Sten Ebbesen, Barbara Faes de Mottoni, Simo Knuuttila, Alain de Libera, Olga Lizzini, Costantino Marmo, Claude Panaccio, Ivan Bendwell, Irene Rosier-Catach, Lambert Marie de Rijk, Leonardo Sileo, Luisa Valente, and Albert Zimmermann.
